On June 28, 2021 Ukrainians from all over the world will celebrate 25 years of the Constitution of Ukraine, the Basic Law of the State, which enshrines the rights, freedoms and responsibilities of citizens of Ukraine and its socio-political and State system. The path to this event was long and thorny, the history of constitutionalism begins with the Constitution of Pylyp Orlyk (Bender Constitution, Constitution of 1710) and is the logical consequence of the development of the national demands of Ukraine: from cultural and political autonomy within the federation to the requirement of independence.
The exhibition of an exhibition project prepared by the State Archival Service of Ukraine and the State archives, includes documents of the National Archives Fond of Ukraine containing information on the constitutional ideas and concepts of famous scientists and politicians of Ukraine, highlight the main periods of the formation of domestic constitutionalism and provide an opportunity for a better understanding of the regularity and peculiarities of this process in Ukraine, from the Constitution of Pylyp Orlyk to the adoption of the new Constitution of Ukraine at the fifth session of the Verkhovna Rada of Ukraine on June 28, 1996, the original of which is stored in the fonds of the Central State Archives of Supreme Authorities and Administration of Ukraine and is a unique document.

1650, February 12. – Constitution of the Warsaw Sejm, November 22, 1649, at which the Treaty of Zboriv was ratified.

The Zboriv peace Treaty 1649 was concluded between the Hetman of Ukraine Bohdan Khmelnytsky and the Polish King Jan-Kazymyr in the town of Zboriv (now Ternopil region) after the victory of the Ukrainian army in the Battle of Zboriv (early August 1649). Ukrainian State – the Zaporozhian Army, the Hetmanate, elected during the National Liberation War of the Ukrainian people in the middle of XVII century, was recognized by the Polish Government within the framework of the Kiev, Chernihiv and Podillya remained part of the Polish-Lithuanian Commonwealth). Despite some unfavorable conditions for Ukraine, in general the Treaty of Zboriv was a significant victory of Bogdan Khmelnytsky in strengthening the Ukrainian state.
1658, September 16.– The Treaty of Hadiach between the Zaporozhian Cossak Army and the Polish-Lithuanian Commonwealth, that determined the legal status of the Ukrainian lands within the Commonwealth of Three Nations.

The Treaty of Hadiach of 1658 was concluded between the Hetman of Ukraine Ivan Vyhovsky and the Polish government in September 1658 in town of Hadiach (now Poltava region). The author of the text is considered Yuriy Nemyrych. Under the terms of the treaty, Ukraine, as an independent state under the name Grand Duchy of Russia, was included on equal rights with Poland and Lithuania (on the basis of a federation) in the state formation – the Commonwealth. The terms of the treaty were not implemented, primarily due to the open aggression of the Moscow state against Ukraine and strong anti-Polish sentiments in Ukrainian society.

Pylyp Orlyk’s Constitution (Bender Constitution, Constitution of 1710) — an agreement and arrangement between Hetman Pylyp Orlyk and the Zaporozhian Army, approved in Bender for the election of Pylyp Orlyk as hetman and the latter’s oath, in which he undertakes to abide by all its provisions Zaporozhian Army. It consists of an introduction and 16 points, which are devoted to the following issues: the issue of faith and protection of the rights of Ukrainian Orthodoxy, the inviolable integrity of borders; restoration of the rights of the Zaporozhian Lowland Army on its land, liquidation of the fortresses built by the tsar in the territories belonging to Kosh and consolidation of the autonomous political and economic status of the Sich as a part of the hetman state; consolidation of the basic principles of organization of power in the Cossack state (proclamation of limiting the prerogatives of the hetman’s power in order to avoid the threat of establishing a despotic government and declaring the establishment of a public council, which should have priority in solving strategic issues of state life); approval of the main functions in resolving public affairs under the General Sergeant (and not the hetman’s servants); approval of the institution of the General Treasurers, who were to monitor state revenues and expenditures and prevent the appropriation of state property by the hetman; defining the administrative responsibilities and rights of the hetman and colonels as heads of territorial and administrative units of the state and establishing a clear procedure for the acquisition of government positions by the officer and the formation of the executive branch, etc.
